ZONING INFORMATION

According to the Pennsylvania Municipalities Planning Code, "Zoning is intended to promote, protect, and facilitate the public health, safety, morals, general welfare, coordinated and practical community development, proper density of population, civil defense, the provisions of adequate light and air, police protection, vehicle parking and loading space, transportation, water, sewerage, schools, public grounds and other public requirements as well as preventing the overcrowding of land, light danger and congestion in travel and transportation, loss of health, life or property from fire, flood, panic, or other dangers.  More specifically these broad purposes are designed to clearly achieve the objectives of the North East Regional Comprehensive Plan and the North East Regional Comprehensive Plan updates."

Zoning does not address building construction codes or property maintenance requirements.  Those standards and requirements, while possibly related, are not part of zoning and are administered separately from zoning. 

Permits or Certificates Required:

The North East Borough Zoning Ordinance states: "No structure shall be located, erected, constructed, reconstructed, moved, altered, converted, or enlarged, nor shall any structure or land be used or be designed to be used except in full compliance with all the provisions of this Chapter and after the lawful issuance of all permits required by this Chapter."

Always check with the borough office before undertaking any of the actions listed above.  For specific requirements, please refer to the Zoning Ordinance and Zoning Map.

To obtain a Zoning or Zoning Occupancy Permit or Certificate, complete a Zoning Certificate Application or Zoning Occupancy Permit Application and submit the application to the Borough Office.

Zoning Certificates

The following lists examples of projects for which a Zoning Certificate is required:

  • Accessory structures separate from a primary dwelling or structure to include sheds, garages, fences, and signs.
  • Additions, renovations, demolitions of any structure on a property.
  • Additional parking, driveways, sidewalks, etc.

A complete Zoning Certificate Application will include:

  • Zoning Certificate Application
  • Plot Drawing indicating all information needed to evaluate the application.
  • Worker's Compensation Insurance certificate or Exemption Affidavit.

Please plan ahead and submit the application well in advance of beginning any project.  For various reasons, processing permit applications may take several days.  Please allow at least 10 business days for initial permit processing.

Stormwater Management and Floodplain Permits

The Zoning Administrator will determine if a Stormwater Management Permit or a Floodplain Permit is required based upon the information provided on the Zoning Certificate Application.

If the proposed work requires a Stormwater Management Permit or a Floodplain Permit, the appropriate application will be provided by the Zoning Administrator.  If either of these permits is required, that permit must be obtained prior to the issuance of a Zoning Certificate.  Floodplain and Stormwater Management Permits may require extensive review the the Borough Engineer.

Zoning Occupancy Certificate

A Zoning Occupancy Certificate must be obtained anytime the use of a property changes.  Examples include, but are not limited to, changing a single family dwelling to a multi-family dwelling, change from one commercial use to another use, or establishing a home occupation business.

A Zoning Occupancy Certificate Application must be submitted and approved prior to any change in use of any structure or property.

Application Approval

Once an application has been reviewed and approved, a Zoning Certificate or Zoning Occupancy Permit will be prepared.  The certificate may be mailed to the applicant or picked up at the Borough Office.  No certificate will be issued, however, until all applicable fees have been paid by the applicant.

Application Denial

If an application is denied, the applicant may request a hearing before the Zoning Hearing Board to seek a variance or special exception.  Please note that the Zoning Administrator is only authorized to approve applications for projects that comply with the requirements, provisions, or conditions stated in the Zoning Ordinance.  The Zoning Ordinance is approved by Borough Council with input from the Borough Planning Commission, the Zoning Hearing Board, and planning consultants.  The Zoning Administrator is limited to a literal translation of the language as it appears in the ordinance.

Building Permits

Zoning and Zoning Occupancy Certificates are issued through the Borough Office.  These certificates, as previously stated, only deal with land or property use.  Building standards and Uniform Construction Code administration is performed by the North East Area Code Administration (NEACA).  After obtaining a Zoning Certificate or Zoning Occupancy Permit, contact NEACA officials to obtain any necessary Building Permits.  NEACA may be contacted at:

NEACA will not typically issue a Building Permit unless an approved Zoning Certificate, or a letter from the Zoning Administrator stating no certificate is required, has been issued.

Driveways and Sidewalks

A Zoning Certificate may be required for the construction, reconstruction, enlargement, paving, or addition of driveways or parking areas.  Always check with the Zoning Administrator prior to beginning driveway projects.

Typically, a Zoning Certificate is not required for the installation or replacement of a pedestrian sidewalk or lead walk.  However, coordination with the Zoning Administrator or the Borough Code Enforcement Officer may be required to ensure compliance with the Americans with Disabilities Act and the Stormwater Management Ordinance.

Zoning Violations

Section 27-605 of the North East Borough Zoning Ordinance states: "Any person, partnership, or corporation who or which has violated or permitted the violation of the provision of this Chapter or prior enabling laws shall, upon being found liable therefore in a civil enforcement proceeding commenced by the Borough, pay judgment of not more than $500 plus all court costs, including reasonable attorney fees incurred by the Borough as a result thereof.  No judgment shall commence or be imposed, levied or payable until the date of determination of a violation by the District Justice.  If the defendant neither pays nor timely appeals the judgment, the Borough may enforce the judgment pursuant to the applicable rules of civil procedure.  Each day that a violation continues shall constitute a separate violation, unless the District Magistrate determining that there has been a violation further determines that there was a good faith basis for the person, partnership, or corporation violating this Chapter to have been only one such violation until the fifth day following the date of determination of a violation by the District Justice and thereafter each day that a violation continues shall constitute a separate violation.  All judgments, costs, and reasonable attorney's fees collected for the violation of the Chapter shall be paid over to the Borough."
